The former personal attorney for Donald Trump has stepped down as the US Attorney for New Jersey. This follows a legal ruling that invalidated her legal standing to hold the office.
Official Departure
The nation's top law enforcement official, the Attorney General, accepted her stepping down on the start of the week. In a statement that the appeals court finding made it impossible for Habba to perform her duties.
"But do not mistake adherence to the ruling as defeat," she declared. "The effort will now reach across the country."
Legal Background
Habba's exit was triggered by a US appeals court found that she had been acting without proper authority as the federal prosecutor. This decision is expected to impact many prosecutions in New Jersey.
The court ruled that a acting appointment that skirted Senate approval ran afoul of the Federal Vacancies Reform Act.
Ongoing Legal Battle
It was also stated that Habba will remain at the DOJ as a senior adviser. Habba plans to pursue additional appeals of the disqualification, with hopes of a different outcome.
In a statement, the Attorney General wrote that judges "cannot be permitted to countermand the President's choice of lawyers responsible for carrying out the executive branch's core responsibility of enforcing the law."
Performance in Office
The attorney general praised Habba's record and noted that while she was in charge, the city of Newark saw a significant drop in crime. Additionally that the Camden experienced its first summer in half a century free from homicides.
Connection to Donald Trump
Habba, 41, was initially recruited to Trump's personal legal team in 2021. Subsequently, she defended her client in his New York criminal case in the previous year, which resulted in his conviction on 34 counts of financial record manipulation.
Prior to assuming the top New Jersey post, the former president had revealed he was appointing her as his White House advisor if re-elected, labeling her as deeply loyal and a "tireless advocate for justice".
