US Judge Orders Release of Abrego Garcia from ICE Detention
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks lawful basis.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.
The situation originates in a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an error. After his return to the United States to face human smuggling charges, he was held in immigration custody.
In her order, the court pointed out that the government lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

The court challenge involve conflicting claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.
He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in Tennessee.
